Terms and Conditions

General         

By registering and accepting these Terms and Conditions, you are entering into a legally binding agreement which incorporates the rules for each “player” or “user” or “you” or player account. These terms and conditions constitute a binding agreement between you and The Gambia Lotto and regulate your use of all gaming services offered by The Gambia Lotto

These Terms and Conditions are applied for your use of this website, including all The Gambia Lotto’s Services which are  Website and USSD. The terms ‘The Gambia Lotto’ or ‘we’ or ‘us' or ‘the services’ are used in these terms and conditions to refer to The Gambia Lotto which is duly registered under the laws of The Gambia. ‘You’, ‘yourself’, ‘user’, ‘player’ or ‘customer’ are terms that are used to refer to you, being the person accessing the services and agreeing to be bound by these terms and conditions.

The Gambia Lotto may change these Terms and Conditions at any time in order to reflect changes to this website and or the services, including additional products or services offered by us or a third party. We will publish any changes to these Terms and Conditions on this website . Your continued use of this website and the services following notification or, as the case may be, such advance notice will be deemed binding acceptance of the modification. If any such change is unacceptable to you, you should not continue to use this website and the services.

It is your sole responsibility to review the Terms and Conditions and any amendments to them each time you use The Gambia Lotto’s services.

The Gambia Lotto may wish to transfer our rights or obligations or sub-contract our obligations under these Terms and Conditions to another other legal entity. You agree that we may do so provided that this will not adversely affect the standard of service you receive under these Terms and Conditions. In the case of transfer only, after we notify you of the date on which we will transfer our rights and obligations under these Terms and Conditions to another legal entity, your only rights under or in connection with these Terms and Conditions will be against the new legal entity and not against us.

These Terms and Conditions are personal to you. You may not transfer your rights or obligations under these Terms and Conditions to anyone else.

If you breach these Terms and Conditions and we take no action against you, we will still be entitled to use our rights and remedies in any other situation where you breach these Terms and Conditions.

If any part of these Terms and Conditions is disallowed or found to be ineffective by any court or regulator, the other provisions shall continue to apply.These Terms and Conditions are not intended to give rights to anyone except you and us. This does not affect our right to transfer these Terms and Conditions.

The Gambia Lotto’s website, the services and these Terms and Conditions are only available in the English language and apply to USSD.

We don't take any responsibility to intend that this website and or the services be used by persons in countries in which such activities are illegal or to be used outside of The Gambia (“the Jurisdiction”). The Gambia Lotto does not constitute an offer, solicitation or invitation by us for the use of, or registration for, betting or other services in any jurisdiction in which such activities are prohibited by law.

It is your responsibility to determine the law that applies in the location in which you are present. You should ensure that you are acting legally in the Jurisdiction in registering as our customer and or betting via The Gambia Lotto’s services.

You are responsible for reporting your winnings and losses if such reporting is required by your local law or tax authorities. It is your responsibility to pay any tax or levy due on any winnings paid to you by us. You must be at least 18 years old to use The Gambia Lotto’s services and to place a bet.

By agreeing to these Terms and Conditions you authorise us to check the details you provide when registering with this website. In particular, we may verify that you are 18 years old or over or that you are resident in the jurisdiction in which you say you are a resident and or that you are the owner of the Mobile Money account that is registered to your player account and any sums deposited in your player account. To help us combat fraud efficiently, in certain circumstances we may ask you to provide physical copies of your personal identification documents in order to verify your registration details.

You will not be able to withdraw winnings from your player account or otherwise receive any winnings if your age verification has been proven to be fraudulent. 

If age verification reveals that you are not 18 years old or over then all deposits or payments made by you will be returned to you, no winnings will be paid and your Player Account will be closed and blocked and your details reported to the authorities.

Playing Responsibly        

The Gambia Lotto conforms to all social responsibilities and believes in responsible gaming. Thus this website and The Gambia Lotto’s services are restricted to persons of legal age (18+) and above. Registration            

To use our range of services, you need to complete the registration process to open a player account. You can register and open a player account by following the register process on each of The Gambia Lotto’s Services. Information supplied by you must be acute and will be validated by our internal processes.
When you open a player account, you will be asked to provide personal information, including, but not limited to, your name and full name, password, age verifications and telephone number. This information will be validated by our mobile money services and if you provide invalid or incorrect information you will not be able or allowed to utilize The Gambia Lotto’s services.
It is your responsibility to ensure that the details provided at registration are accurate and kept up-to-date (including and not limited to your mobile number). You can change the details you provide at registration at any time by editing your player account preferences or contacting customer services using the details below but you are not authorised to change your registered mobile number without contacting customer support directly and you will have to supply additional documentation to support the request for change. 

After opening your player account, you must keep your password secret. We recommend that you regularly change the password. We ask that you ensure your transactions are limited to one account only.


All transactions where your phone number and password have been entered correctly will be regarded as valid, whether or not authorised by you, and we shall not be liable for any claims in the event that you disclose them to anyone. It is your sole responsibility to maintain the confidentiality of your password and you are responsible for all activity that occurs under your phone number and password. You should notify us of any unauthorised use of your password and any breach of security as soon as you become aware of it.


If you lose or forget your password please follow the password recovery instructions on The Gambia Lotto’s services or contact our customer services team using The Gambia Lotto contact details provided. It is your responsibility to contact our customer services team immediately to request a replacement password.


We retain the right to void any transactions or suspend your player account where you have provided incorrect details. In such a situation, all stakes or bets made will be returned and any winnings accrued at such time shall be forfeited.

 

Deposits and Withdrawals

You may only bet or wager with the amount of cleared funds held in your account. Accordingly, if you want to place bets or participate in gaming, you should only deposit money into your account, for the purpose of you using such money to place bets/ or wagers. You should only deposit funds into your account from a source where you are the named account holder.

 

No credit will be offered, and all bets must be supported by sufficient funds in the customer account. The Gambia Lotto reserves the right to void any bet or wager which may have inadvertently been accepted when the account did not have sufficient funds to cover the bet/wager. Should funds be credited to a customer's account in error it is the customer's responsibility to inform The Gambia Lotto without delay. The Gambia Lotto will recover such funds by account adjustment.

 

You are only entitled to use our currency exchange service for the purpose of placing bets or wagers. You are not entitled to use this service for any purpose other than the authorised purpose.

 

In addition, The Gambia Lotto shall be entitled to withhold and/or retain any and all amounts earned or received by you as a result of or in connection with your ‘unauthorised’ use including activities which are not for an authorised purpose.

 

Where possible, all withdrawals will be processed to the payment account from which the deposits were made. Withdrawal payments can only be made in the name of and to the registered account holder and The Gambia Lotto will verify the identity of the customer before any withdrawal is completed.

 

For most payment types, withdrawals can be processed by clicking 'Withdraw' on the Website, subject to there being sufficient funds in your betting account. There is no set maximum withdrawal amount per day.

 

If we incur any charge-backs, reversals or other charges in respect of your account, we reserve the right to charge you for the relevant amounts incurred. We may, at any time, set off any positive balance on your account against any amounts owed by you to The Gambia Lotto.

You are responsible for reporting your winnings and losses to the tax and or other authorities in your jurisdiction.

The Gambia Lotto is not a financial institution and no interest is paid on any customer funds irrespective of the amount held in the customer’s account.

 

 

Suspension            

The Gambia Lotto reserves the right to suspend, modify, remove and or add to the services and or to this website at our sole discretion with immediate effect and without notice.

The Gambia Lotto will not tolerate fraudulent activities. If, in our reasonable determination, you are found to have attempted to defraud us, any other user of this website or any person in any way, including payment fraud, or if we suspect you of fraudulent payment, any other fraudulent activity or prohibited transaction (including but not limited to money laundering), we reserve the right to suspend and or close your Player Account, withhold any or all winnings and share information (together with your identity) with the appropriate authorities.

You must not misuse The Gambia Lotto’s services by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to this website; the servers on which this website is stored; or, any server, computer or database connected to this website or used to provide the services. We will report any such breach to the relevant law enforcement authorities and we will cooperate with those authorities by disclosing your identity to them.  You agree that you will not use The Gambia Lotto’s services in any way that may lead to the encouragement, procurement or carrying out of any criminal or unlawful activity, or cause distress, harm or inconvenience to any other person.

If you request a refund to The Gambia Lotto from any wager made due to an outside party, including family, using a fraudulent device in any manner to place a bet your account will be blocked and you will no longer be allowed to access The Gambia Lotto’s services. It will be at The Gambia Lotto’s discretion to refund your wager after an internal investigation and your details may be handed over to the authorities if it is found that you or the said party have been acting unlawfully and fraudulently.

A Players account, at the discretion of The Gambia Lotto, may be temporarily suspended (for a minimum of six months) if the player makes wagers and requests a refund due to the fact they can not afford the wager hence needing partial or full refund . This is to protect the player from further unsustainable debt and complies with our Responsible Gambling Policy.

Money Laundering

You certify that all the funds you deposit in your account within The Gambia Lotto, are not from an illegal source. You shall not use The Gambia Lotto’s services for the purpose of transferring such funds from illegal sources.

You conform for not using The Gambia Lotto’s services for any illicit or fraudulent activity, or for any unlawful or fraudulent transactions.

The Gambia Lotto reserves the right to suspend or close your account at any time if we suspect that you may be engaging in, or have engaged in fraudulent, unlawful or improper activity, including money laundering activities or any conduct which violates these Terms.

If your account is terminated or blocked for these reasons, we are under no obligation to refund to you any money that may be in your account. In addition, The Gambia Lotto is entitled to inform relevant authorities of your suspected unlawful, fraudulent or improper activity.

Self Restrictions

The Gambia Lotto allows you, the player, to self regulate your account and create restrictions for playing and spending money. These restrictions can be changed and when updated are in place for a minimum of six months. You are able to limit how many times you can wager per day, per week and per month. This is in line with the Responsible Gambling policy. If you feel you have changed these settings in error you must contact support directly and it will be at the discretion of The Gambia Lotto which settings that can be reverted after reviewing your playing behaviour.

Liability    

Nothing in these Terms and Conditions will:

Exclude or limit our liability for fraud or fraudulent misrepresentation or for death or personal injury resulting from our negligence; or restrict your statutory rights (statutory rights include, for example, that we will provide The Gambia Lotto’s services to a reasonable standard and within a reasonable time).

We will not be responsible under these Terms and Conditions for any loss that could not have been reasonably expected by you and us at the time you registered with The Gambia Lotto or at the time you entered into a transaction with us (for example, any loss of income, business or profits or any information which is lost or corrupted) and, in any event, we will not be liable for any damage or loss suffered or incurred by you as a result of any use of The Gambia Lotto’s services in breach of these Terms and Conditions (including any use of this website and or the services for commercial or business purposes); failures caused by the equipment you use to access this website and or the services or failures in any network (including failures by your internet service provider); any lost or delayed transactions (including as a result of technical failure); damage to your computer or for any loss or corruption of data that results from your use of this website and or the services (and we cannot and do not guarantee that any files that you download are free from viruses, contamination or destructive features); or our cancellation or suspension of the services in accordance with these Terms and Conditions.

The Gambia Lotto does not guarantee which services will be available on this website. The services and this website are provided on an 'as is' and 'as available' basis. The Gambia Lotto cannot promise that this website and the services will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. We will provide the services with the reasonable skill and care described in these Terms and Conditions. We do not make any other promises about how the services will be provided to you or about your access to this website.

The Gambia Lotto is not responsible for any events beyond our reasonable control. Such events might include war, terrorist activity, riots, malicious damage, fire, flood, storm, nuclear accident or compliance with any new law or governmental order, rule, regulation or direction.

The Gambia Lotto may suspend this website and or the services or any part of them if, despite making reasonable efforts to do so, we are not able to provide that part of the services and or website to you as a result of events beyond our reasonable control. You agree to compensate us in respect of any damages suffered by us or any of our losses resulting from any claim made by a third party in each case in respect of any matter arising from your use of this website and or the services in breach of these Terms and Conditions or from your breach of any applicable law or regulation.
